ObamaCare = Unconstitutional Socialist Brinkmanship


Judge Andrew Napolitano -Fox News analyst and author of Constitutional Chaos: What Happens When the Government Breaks Its Own Laws - seems extraordinarily qualified to ascertain just what today's power-drunk Dems are up to... what the end-game is... and if they should actually be allowed to get away with any of this.

And Napolitano argues here (5:00) that forcing Americans to get mandatory insurance policy is completely and utterly unconstitutional- as would be any law requiring us to buy a specific good or service:



But as Pelosi and Obama have both made abundantly clear, they do intend to tell you what insurance you have to buy... while seeing nothing wrong with throwing you in the can for a few months if you dare to disobey.

Even a number of Democrats have their doubts about the legality- when asked if the constitution gave the right to the government to mandate healthcare coverage, Senator Akaka of Hawaii said that he was not aware of any provision in the constitution that granted the government this right.

WH spokesman Robert Gibbs was pressed in a presser last-week, regarding the constitutionality of such an unprecedented mandate- and he had no real answers.

But Senator Orrin Hatch sure had a thing or two to say about it, though...

Such a Stalin-esque diktat from the Dear Leader -enforced with threats of fines and even prison-sentences- is of course an outrageous power grab, and completely un-American.

Obama has no authority to do this.... just like he had no power to fire the head of GM, nor to snake bondholders' equity and give auto companies to the UAW... but he went-ahead and did it anyway because we let him.

Tragically, this president has not interest nor experience in managing anything in a pragmatic manner... his career was built on shady political deals/"soaring rhetoric"/rabble-rousing for a fantastical far-left agenda... while putting-on a nice-guy act for the middle-class (per Alinsky).

Primary duties of his current job -like maintaining or incrementally improving American assets, economy, and strategic position dosn't bring him what he's looking for, either- megalomaniacs aren't really that into just watching the shop.

Rather than any managerial skills and balanced judgement, Obama's decision-making process is propelled by cynical political opportunism and a warped, narcissistic drive that keeps him hungry for political conquest and ego gratification. Meanwhile, a bloated sense of self-import has him living in a fantasy-world where he's some sort of international Che Geuvara... so he's not going to stop all this until more sane people stand-up and tell him NO.

With the press and other Obots programmed to march in tight formation -promoting and even making excuses for the incompetent, radical Obama- patriots of the TEA party movement/conservative blogs/principled conservatives like Sarah Palin are the only ones who can draw the line prior to mid-term elections, thereby limiting the damage... and we intend to do just that.

This whole episode -as with the Porkulus- shows just how anxious Obama is ram unhelpful, unneeded, and fiscally reckless legislation down our throats as he deems necessary- and with little concern for it's wisdom, public support, or even legality.


It's sure hard to see the justification for the Senate passing such dubious legislation, inviting years of court challenges- seems pretty irresponsible. And if ObamaCare is so fiscally dependent on the mandate, what happens to our new statist HC system when/if that gets ruled unconstitutional?

As noted by Ann Althouse:
Has anyone promoting this bill even attempted to calculate the economics with the individual mandate excised?
Are we going to have the whole lumbering system cranking into operation for years before we find out whether the the individual mandate is unconstitutional?
Or is that the scheme? The individual mandate is too big to fail, and the courts will cave.
President Obama needs to realize he's not in Chicago anymore... that the US Constitution trumps his agenda every time... and if they somehow manage to cobble enough votes together in the Senate for this monstrosity and stick us with an individual HC mandate, we'll see you in court.
